Algorithms, instead of being neutral, can reproduce and intensify social prejudices and inequalities.In India, an extremely stratified society, addressing algorithmic bias is not only a legal but also an ethical requirement. It is our position that the constitutional guarantees of equality, non discrimination, and privacy, along with recent data protection legislation, should be applied and extended to this subject to address the biases hidden within Artificial Intelligence (AI) systems. This paper maps Indian law and global ethical standards to identify gaps in
regulation and proposes an integrated, rights based framework to ensure fair AI.
