dc.description.abstractThe subject of the thesis is the European Union’s Regulation 2019/515 on the mutual recognition of goods. Since the free movement is of fundamental importance to the internal market of the EU, it is important that barriers to trade in goods are minimised. Alongside harmonisation, mutual recognition is a central tool to ensure that goods move freely between EU Member States. Therefore, the EU legislature has introduced Regulation 2019/515 to ensure mutual recognition of goods functions properly. This is the third try to regulate the evaluation of unjustified national measures, so it is important to consider, whether the Regulation has managed to improve the existing system. The paper evaluates the Regulation through the doctrinal legal research method, supporting it with a historical perspective and with analysis on empirical materials. The analysis suggests that while the Regulation develops the existing procedural system and aims to address problems with previous legal instruments, practical effects to trade in goods remain unproven. Therefore, it is worth considering, if the tools could be strengthened by stricter safeguards for compliance. However, the fundamental conflict between national autonomy and free movement continues to shadow mutual recognition, limiting its effectiveness in practice.
dc.description.abstractTutkielman aihe on Euroopan Unionin asetus 2019/515 tavaroiden vastavuoroisesta tunnustamisesta. Tavaroiden vapaa liikkuvuus on erittäin tärkeä osa EU:n sisämarkkinaa, joten on tärkeä minimoida tavaroiden kaupan esteet. Lakien yhdenmukaistamisen ohella vastavuoroinen tunnustaminen on keskeinen keino varmistaa, että tavarat liikkuvat vapaasti EU:n jäsenmaiden välillä. Tästä syystä EU:n lainsäätäjä on luonut asetuksen 2019/515, joka pyrkii vähentämään perusteettomia esteitä tavaroiden pääsylle markkinoille. Tämä on kolmas yritys säädellä kansallisia toimia, jotka rajoittavat tavaroiden pääsyä markkinoille. Siten on tärkeää tarkastella, onnistuuko asetus kehittämään nykyistä järjestelmää. Asetusta arvioidaan tutkielmassa oikeusdogmaattisesta näkökulmasta, jota tuetaan historiallisella näkökulmalla ja analysoimalla empiirisiä lähteitä. Analyysi viittaa siihen, että vaikka asetus kehittää aikaisempaa prosessuaalista järjestelmää ja pyrkii puuttumaan aikaisempien oikeussäädösten ongelmiin, käytännön vaikutuksista tavaroiden kauppaan ei ole todisteita. Siten on aiheellista pohtia, voisiko järjestelmää kehittää luomalla tiukempia vakuuksia sille, että jäsenmaat noudattavat asetusta. Toisaalta jäsenmaiden itsenäisyyden ja vapaan liikkuvuuden välinen perustavanlaatuinen arvoristiriita varjostaa yhä vastavuoroista tunnustamista, mikä myös rajoittaa sen tehokkuutta käytännössä.
